By accessing and using MagicSocial, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily use MagicSocial for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials
  • use the materials for any commercial purpose or for any public display
  • attempt to reverse engineer any software contained on the website
  • remove any copyright or other proprietary notations from the materials

3. Service Description

MagicSocial provides AI-powered Instagram post scheduling services. We reserve the right to modify, suspend, or discontinue the service at any time without notice.

4. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

5. Payment and Billing

Subscription fees are billed in advance on a monthly or annual basis. We reserve the right to change our pricing with 30 days notice.

5.1. No Refund Policy

All subscription fees are final and non-refundable. This policy applies to all plans, including monthly and annual subscriptions, regardless of usage or cancellation timing.

Why we have a no-refund policy:

  • Immediate Access to Services: Upon payment, you gain immediate and full access to all features, AI-powered content generation, and automated posting services. The value is delivered instantly upon subscription activation.
  • Digital Service Nature: MagicSocial provides digital services that cannot be "returned" in the traditional sense. Once content is generated and services are rendered, the value has been delivered.
  • Resource Allocation: Your subscription enables us to allocate AI processing resources, maintain infrastructure, and provide ongoing support. These costs are incurred immediately upon service activation.
  • Fair Usage: This policy ensures fair pricing for all users and prevents abuse of our service. It allows us to maintain competitive pricing while providing high-quality, automated content generation.
  • Transparent Pricing: All pricing is clearly displayed before purchase, and you can cancel your subscription at any time to prevent future charges. You will retain access until the end of your current billing period.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will continue to have access to all features until that time. No partial refunds will be provided for unused portions of your subscription period.

Exceptions: Refunds may only be provided in cases where required by applicable consumer protection laws in your jurisdiction, or in the event of a technical error on our part that prevents you from accessing the service for an extended period. All refund requests must be submitted within 7 days of the charge date and will be evaluated on a case-by-case basis.

6. Content and Intellectual Property

You retain ownership of all content you create using MagicSocial. You grant us a license to use your content solely for the purpose of providing our services. You are responsible for ensuring your content does not infringe on third-party rights.

7. Prohibited Uses

You may not use MagicSocial:

  • for any unlawful purpose or to solicit others to perform unlawful acts
  • to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • to infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • to submit false or misleading information

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Disclaimer

The information on this website is provided on an "as is" basis. To the fullest extent permitted by law, MagicSocial excludes all representations, warranties, conditions and terms relating to our website and the use of this website.

10. Limitation of Liability

In no event shall MagicSocial, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

11. Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
